Same Day Visa Service For Tier 1 PSW Application

We are registered with the Home Office Public Enquiry Office (PEO), Lunar House, Croydon to provide same day visa service for Tier 1 Post Study Work (PSW) applications. Dependants Of Tier 1 PSW Migrant

A Tier 1 PSW Migrant is permitted to sponosr his dependants (children under 18 years of age, or your husband, wife, civil partner, or unmarried or same-sex partner) to join him in the UK if the dependents are living abroad.

If the dependents are already in the UK, they will be able to apply for dependant visa along with the main applicant as long as they have dependant visa and are already living in the UK as dependant of the main applicant. Those dependants who are not on dependent visa (dependent of the main applicant) will not be able to switch to Tier 1 PSW Dependant visa from inside the UK and will have to leave the UK to apply from their country of nationality. A UK born child of the Tier 1 PSW Migrant can apply for dependant visa from inside the UK and will not have to leave the UK to apply for PBS dependant visa from abroad.

The amount of funds for maintenance required for the application of the dependent will depend on whether or not the dependant is applying at the same time as the main applicant. For dependants who are not applying at the same time as the main applicant, the amount of funds required will depend upon whether or not the main applicant has already resided in the UK for at least 12 months.

Frequently Asked Questions (FAQs) About Tier 1 PSW

Q.1: When is the Tier 1 PSW category closing?

Answer: The Home Office, UKBA has announced that the Tier 1 PSW category will be closed in April 2012. Tier 4 Students will no longer be able to apply for Tier 1 PSW Migrant visa after the category is closed in April 2012.


Q.2: After how long of award of my degree certificate I can apply for Tier 1 PSW visa?

Answer: You can apply for Tier 1 PSW visa any time within 12 months of the award date of your degree certificate. As the category is closing in April 2012, the application for Tier 1 PSW should be made before the category is closed.


Q.3: From where can I download the Tier 1 PSW application Form to apply from inside the UK?

Answer: You can download the Tier 1 PSW application Form from the UKBA Website.


Q.4: From where can I download the application Form to apply for Tier 1 PSW from outside the UK?

Answer: You can download the Application Form VAF 9 and the PBS Appendix 4 Post-Study Work Self Assessment Form the UKBA Visa Services Webstie to apply for Tier 1 PSW from outside the UK.


Q.5: Can I apply for Tier 1 PSW Visa from inside the UK even after the expiry of my Tier 4 Student visa?

Answer: Yes, you can apply for Tier 1 PSW visa even if your Tier 4 Student visa has already expired. An out of time application can be made through same day visa service if your Tier 4 Student visa did not expire more than six months ago. If your Tier 4 Student visa expired more than six months ago, you can still apply for Tier 1 PSW but only by post and not through same day visa service.


Q.6: For how long will I be granted Tier 1 PSW visa if I am switching from Tier 4 General visa to Tier 1 PSW visa?

Answer: Tier 1 PSW is granted by the Home Office, UKBA for two years. As a Tier 1 PSW migrant, you will have permission to take up employment as well as self-employment in the UK. You cannot extend your Tier 1 PSW visa and will have to switch into some other category e.g. Tier 4 (General) Student or Tier 2 General category before the expiry of your Tier 1 PSW visa.


Q.7: What are the requirements for my Tier 1 PSW application to succeed?

Answer: For your Tier 1 PSW application to be successful, you must score a total of 95 points and meet all the other requirements of the Immigration Rules.

You must score:

  • 75 points for your attributes, which are a United Kingdom qualification, study at a United Kingdom institution, your immigration status during United Kingdom study and/or research, and the date of award of the qualification; and
  • 10 points for English language; and
  • 10 points for available maintenance (funds).
 
Q.8: Can I use the same day visa service to apply for Tier 1 PSW from outside the UK?
Answer: No, you cannot use the same day visa service to apply for Tier 1 PSW from outside the UK. The Home Office UKBA does not offer such service for out of country applications except in very few countries like USA.

Q.9: Is Tier 1 post study Work (PSW) visa counted in 10 years long residence to apply for ILR under the 10 years long residence category?
Answer: Yes, the stay under the Tier 1 PSW is counted towards continuous and lawful residnece for the purposes of ILR application under the 10 years long residence category.

 

Q. 10: I am in the UK on Tier 4 General Student visa and my spouse is also on Tier 4 General Student Visa. Can my spouse apply for Tier 1 PSW Dependant visa as my dependant when I apply for Tier 1 PSW visa?

Answer: As your spouse is not your dependant in the UK, therefore he/she cannot switch to PBS dependant visa from inside the UK. Your spouse will have to leave the UK and apply for PBS dependant visa from his/her country of nationality.


Q.11: What is the processing time (waiting time) for Tier 1 Post Study Work (PSW) visa applications?

Answer:

  • An in-country application for Tier 1 PSW visa submitted through our same day visa service is usually decided by the Home Office, Public Enquiry Office (PEO) within 24 hours.

 

 

Q. 12: What is the date of my application if I am applying for Tier 1 PSW visa from outside the UK?

Answer: The date of your application is the date when your application fee is paid to the Home Office, UKBA. This will be the date shown on your payment receipt, which depends on how you paid for your visa application - for example, at a visa application centre or online.


Q.13: Within how many days I have to appeal against the refusal of my Tier 1 PSW application?

Answer: If your Tier 1 PSW application has been refused by the Home Office, UKBA, you may have a right of appeal against the refusal of your application if you submitted your application before the expiry of your leave and you did not have a valid leave at the time of decision on your Tier 1 PSW application. Notice of appeal must be received by the 1st Tier Tribunal within 10 working days of the date of receipt of the refusal letter (if you are not detained). If you do not get right of appeal against the refusal of your Tier 1 PSW application, you can still challenge the refusal by way of Judicial Review in High Court.

The application fee that you must pay depends on whether you are applying from inside or outside the UK - and, if you are inside the UK, on whether you are applying by post or in person.

  • If you cannot afford to pay our fee in full at the time of instructing us in relation to your application, you can pay half of the fee at the time of instrucing us and the balance can be paid by monthly installments.
