An Administrative Review is a legal process that allows you to request the Home Office (UKVI) to reconsider its refusal decision if you believe an error has been made in your UK visa and immigration application. It applies to certain UK visa and immigration decisions, including refusals of:

An Administrative Review right is not an available option for challenging all types of refusal decisions, and you can only file an Administrative Review if the visa refusal decision of the UKVI confirms that you have a right to request an Administrative Review. 

The time limit for filing an Administrative Review (AR) depends on whether you are applying from inside the UK or outside the UK. 

Time Limit for AR from Inside the UK: If the immigration application, which has been refused, was submitted from inside the UK, you must apply for an Administrative Review (AR) from inside the UK within 14 calendar days of receiving your refusal notice (or 7 days if detained). 

Time Limit for AR from Outside the UK: If the UK visa and immigration application, which has been refused, was submitted from outside the UK, you must apply for an Administrative Review (AR) from outside the UK within 28 calendar days of receiving your refusal notice. 

You can file an Administrative Review (AR) online, providing reasons and grounds to challenge the UKVI's refusal decision. You must pay the UKVI fee of £80 to submit the Administrative Review (AR) online. Where permitted, you can provide additional evidence in support of your Administrative Review (AR). You must ensure that you file the Administrative Review (AR) of your visa refusal within the time limit given in the refusal letter issued by the UKVI. 

The processing time for an application for an Administrative Review (AR) is typically 6 to 12 months. Due to a huge backlog, the UKVI often delays a decision on the Administrative Review (AR). Where possible, you can consider filing a fresh application instead of an Administrative Review (AR) as long as doing so does not prejudice you. 

The outcome of your Administrative Review may lead to several possible outcomes. 

  • The Home Office UKVI may agree that there was an error and withdraw/refund the decision, and as a result, you will receive the leave intended in the original application.   
  • The Home Office UKI may uphold the refusal decision entirely, maintaining all refusal reasons for refusal.
  • The Home Office UKVI may uphold the refusal decision and withdraw some refusal reasons.
  • The Home Office UKVI may maintain the decision with different or additional reasons, which may give rise to a second Administrative Review if newly stated reasons qualify and your letter says so

There is no appeal from the AR decision unless new reasons arise and you’re told that another AR is available. If the decision to refuse is upheld, you may consider challenging it further through a Pre-Action Protocol (PAP) letter and judicial review, where appropriate.
