Frequently Asked Questions (FAQs)

The following are various Frequently Asked Questions (FAQs) about the UK immigration appeals:

A UK immigration appeal is a legal process through which you can challenge a refusal decision made by the Home Office, UKVI. The appeal is heard by an independent judge at the First-tier Tribunal (Immigration and Asylum Chamber), who reviews the decision to determine whether it was lawful.

It is essential to act quickly. The deadline to lodge a UK immigration appeal to the First Tier Tribunal (FTT) is:

  • 14 days from the date of the decision, if you are inside the UK
  • 28 days from the date of the decision, if you are outside the UK
  • 5 working days for deportation appeals while detained

Missing the appeal deadline can jeopardise your right to challenge the refusal. Contact our team as soon as you receive your refusal letter for immediate legal advice.

You can appeal a UK visa refusal if you have been given a right of appeal in your refusal letter. This typically applies to decisions involving human rights claims (e.g., spouse visas, partner visas, family reunification) or applications made under the EU Settlement Scheme.

You may have a right of appeal against a visa refusal decision if:

  • Your human rights (such as the right to private and family life under Article 8 ECHR) are engaged
  • You applied for a family visa, such as a spouse visa, partner visa, or parent visa
  • Your application was under the EU Settlement Scheme
  • You are appealing against a revocation of refugee status or humanitarian protection
  • You are appealing against the refusal of a long residence application
  • You are appealing a decision to deport or remove you from the UK

If you do not have a right of appeal, you may be able to challenge the decision through an Administrative Review or Judicial Review.

The most common grounds for appeal against the UK visa refusal include:

  • Breach of your human rights (e.g. Article 8 – right to family and private life)
  • Incorrect application of the Immigration Rules and UKVI guidance
  • Failure to consider important evidence
  • Procedural unfairness or legal errors

To appeal against the UK visa refusal, you must complete and submit a Notice of Appeal (Form IAFT-1) to the First-tier Tribunal and pay the applicable fee (unless exempt). You will also need to comply with the court directions and provide Skeleton Arguments/Grounds of Appeal and supporting documents in the form of an Appellant's indexed and paginated bundle. Legal assistance is strongly recommended for preparing a strong UK immigration appeal.

In most cases, yes. Appeals can be decided either:

  • On the papers (without a hearing), or
  • At an oral hearing, where you and your legal representative can present your case before an immigration judge.

Oral hearings usually provide a better chance of success in a UK immigration appeal.

The UK immigration appeal process can take several months, depending on the complexity of the case, tribunal scheduling, and whether further evidence is required. Some appeals may take 6–12 months or longer to conclude.

If you appeal in-time from within the UK and have a right of appeal, you are generally allowed to remain in the UK lawfully while your appeal is being considered.

If your immigration appeal is successful, the Home Office must reconsider its refusal decision and take action in line with the tribunal’s ruling. This would typically mean granting the visa or leave that was originally refused.

If your UK immigration appeal is refused, you may be able to challenge the tribunal’s decision by appealing to the Upper Tribunal, but only if there is an error of law. You can also consider submitting a fresh application depending on the circumstances.

Yes. Our experienced immigration appeal solicitors can assess your refusal decision, prepare strong legal grounds, represent you at hearings, and guide you through the entire immigration appeal process on a fixed-fee basis. We handle appeals for clients both inside and outside the UK.
