You can apply for a Student Visa or Child Student Visa if you wish to study at a UK educational institution that is an approved sponsor licensed by the Home Office. The Student Visa is for applicants aged 16 or over, while the Child Student Visa is for children under the age of 18. Students aged 16 or 17 may be eligible to apply under either category, depending on their circumstances. According to UK Immigration Rules, a person who is aged 16 or 17 and wants to study with a sponsor that is an Independent School on a course at the Regulated Qualifications Framework 3 or Scottish Credit and Qualifications Framework 6 and above can apply as either a Student or as a Child Student (see Appendix Child Student).

A person who wants to study a course for 6 months or less without a student sponsor but with an accredited provider should apply under Appendix V: Visitor. A person aged 16 or over who wants to study an English Language course of 11 months or less without a student sponsor but with an accredited provider, should apply under Appendix Short-term Student.

If applying for permission to stay, the applicant must not have, or have last been granted, permission:

  • as a Visitor; or
  • as a Short-term Student; or
  • as a Parent of a Child Student; or
  • as a Seasonal Worker; or
  • as a Domestic Worker in a Private Household; or
  • outside the Immigration Rules

You can challenge the refusal of your student visa application by filing an Administrative Review (AR) of the UKVI decision to refuse your student visa application. A request for an Administrative Review (AR) must be filed online with the Home Office UKVI within 28 days if your out-of-country application for a student visa is refused and within 14 days if your in-country application for a student visa is refused.
