The Tier 1 Entrepreneur visa route is now closed to new applicants. However, existing Tier 1 Entrepreneur visa holders can still apply for Indefinite Leave to Remain (ILR), provided they meet the requirements outlined in Part 6A: The Points-Based System and Appendix A: Attributes of the Immigration Rules.

According to UK immigration rules, the application for indefinite leave to remain must have been made:

  • before 6 July 2027, if the applicant has ever previously had leave as a Tier 1 (Graduate Entrepreneur) Migrant; or
  • before 6 April 2025, in all other cases.

Can I still apply for ILR as a Tier 1 Entrepreneur?

Yes. Although the Tier 1 Entrepreneur visa route is closed to new applicants, existing visa holders who have ever previously had leave as a Tier 1 (Graduate Entrepreneur) Migrant can still apply for Indefinite Leave to Remain (ILR) before 6 July 2027 and before their current leave expires.

What is the qualifying period for ILR as a Tier 1 Entrepreneur?

You can apply for ILR after spending:

  • 5 years in the UK under the Tier 1 Entrepreneur route (standard route); or

  • 3 years if you meet the accelerated ILR criteria, such as creating 10 full-time jobs or generating at least £5 million in business income.

What are the main requirements for ILR as a Tier 1 Entrepreneur?

To qualify for ILR as a Tier 1 Entrpreneur, you must:

  • Have continuously resided in the UK under the Tier 1 Entrepreneur category.

  • Be actively engaged in business in the UK.

  • Have created at least 2 full-time jobs for settled workers.

  • Meet the English language requirement and pass the Life in the UK Test.

  • Not have breached immigration laws during your residence.

  • Provide substantial documentary evidence demonstrating business activity and job creation.

What counts as a full-time job for ILR as a Tier Entrepreneur purposes?

A full-time job means a position of at least 30 hours per week, created for a settled worker (British Citizen, ILR holder, EEA national with permanent status, etc.) and sustained for at least 12 consecutive months.

Can I combine different jobs to meet the job creation requirement?

Yes. You can combine different positions as long as:

  • They were created for settled workers.

  • Each job lasted at least 12 months.

  • The total number of jobs meets the required minimum of 2 full-time positions.

Are absences from the UK allowed during the qualifying period for ILR as a Tier 1 Entrepreneur?

Yes, but you must not have been absent for more than 180 days in any 12-month period during your qualifying residence. Excessive absences may affect your eligibility for ILR.

What documents will I need for my ILR application as a Tier 1 Entrepreneur?

The documents to be provided in support of your ILR application will vary depending on the type of business and your circumstances. Usually, you will need to provide the following evidence in support of your ILR application as a Tier 1 Entrepreneur:

  • Company registration and trading activity.

  • Annual accounts.

  • Business bank statements.

  • HMRC tax returns, VAT returns, and CT600.

  • Employment contracts and payslips.

  • RTI submissions to HMRC.
